TERMS AND CONDITIONS OF THE DONATION COLLECTION SERVICE

Public offer to enter into a donation contract

CHARITY ORGANIZATION “UKRAINIAN FOUNDATION OF VETERINARY MEDICINE”, represented by Olena Tarasivna Rudneva, offers individuals and legal entities to donate the following conditions:

Terms:

1.1. By the Civil Code of Ukraine, this offer is a public offer (hereinafter – the Offer).
1.2. Terms used in this Offer have the following meanings:
“Donation”, “Donate” – “free transfer of funds, other property, property rights”;
“Benefactor” – “natural and legal persons who make donations”;
“Recipient of donation” – CHARITY ORGANIZATION “UKRAINIAN FOUNDATION OF VETERINARY MEDICINE” or “Fund”.
1.3. The offer is valid indefinitely from the moment it is posted on the Donation Recipient’s website.
1.4. The recipient of the donation has the right to cancel the Offer at any time by removing it from their website page.
1.5. The invalidity of one or more conditions of the Offer does not entail the invalidity of all other conditions of the Offer.

Essential terms of the donation agreement:

2.1. The donation is used to maintain and conduct the statutory activities of the Recipient of the donation and the Foundation’s projects.
2.2. The amount of the donation is determined by the Benefactor.
2.3. Estimated collection period until 12/31/2025.
2.4. The amount of the fee is UAH 4,020,000. or equivalent amounts in US dollars or Euros at the time of the donation.
2.5. If the project or assistance will not be implemented, then by the requirements of Part 6 of Art. 18 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the specified balance will be directed to other projects of the Fund, to other charitable funds engaged in the protection of animals, and in their absence will be directed to the State Budget of Ukraine.
2.6. The benefactor knows and agrees that the amount of the donation is non-refundable and agrees to its redistribution/use in other projects (for example, if the fundraiser is closed or not relevant).

The procedure for concluding a donation contract:

3.1. By the Civil Code of Ukraine and the Law of Ukraine “On Charitable Activities and Charitable Organizations”, the donation contract is concluded in writing by accepting the Benefactor’s Offer.
3.2. The offer can be accepted by the Benefactor transferring the funds to the Donation Recipient by payment order according to the details specified in section 5 of the Offer, specifying the name of the Fund’s need in the “Donation purpose” line:
– for UVMF activities;
– for the recovery of the veterinary case;
– for the treatment of animals;
– to help shelters;
– for veterinary education;
– in support of soldiers and vets affected by the war.

3.3. Transfers of donations are carried out using plastic cards, electronic payment systems, and other means and systems that allow the Benefactor to transfer donations to the Recipient as funds.
3.4. Performance by the Benefactor of any of the actions provided for in clause 3.2. Offers are considered acceptance of the Offer by the Civil Code of Ukraine.
3.5. The date of acceptance of the Offer – the date of conclusion of the donation contract – is the date of receipt of the donation as funds from the Benefactor to the account of the Recipient of the donation.
3.6. The recipient of the donation has the right to use a part of the charitable donation for administrative expenses of the Foundation in an amount not exceeding that provided for by the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
3.7. The recipient of the donation uses charitable donations by its statutory activities and the Foundation’s projects. Charitable donations received by the Foundation may be returned to the Benefactor only in the cases provided for by the legislation of Ukraine and this Agreement or
3.8. The Foundation is responsible for the violation of the terms of this Agreement and the use of charitable donations contrary to the procedure provided for by the Foundation’s statutory activities and the legislation of Ukraine, by the current legislation of Ukraine.

Final provisions:

4.1. By performing the actions provided for in this Offer, the Benefactor confirms that he is familiar with the terms of the Offer, the goals of the Donation Recipient, is aware of the significance of his actions, and has the full right to perform them, fully and unconditionally accepts the terms of this Offer and gives his consent to the collection, processing and use personal data.
The benefactor agrees that after entering information about himself on the Foundation’s website, his contact information may be used by the Foundation to send letters and messages, including in electronic form. At the same time, the Foundation undertakes not to provide information about the Benefactor’s contact details to third parties, except in cases expressly provided for by the legislation of Ukraine. In addition, the Benefactor gives his consent that information about him (in particular, surname, first name, patronymic) may be used by the Foundation in mass media, on the Internet, or the Foundation’s website https://uvmf.org/
4.2. This Offer is regulated and interpreted by the current legislation of Ukraine.
